2. Accuracy of information and disclaimer

We expect many of those contributing to our message boards to have strong views about the matters discussed, but the site is subject to the laws of libel and you and we could be sued if you are not careful in what you say. You should not make libellous postings or any postings which are illegal or breach copyright, database or other related rights. It is your responsibility to check this out and we do not accept any liability in this respect.

If you see any information which breaches your or anyone else's rights or may be illegal, defamatory or otherwise should be removed, let us know immediately and, where we agree, we shall do our best to remove it as soon as possible.

You must indemnify (pay) us for any losses we suffer if you breach this provision or any other provision of these terms or the bulletin board rules of posting.

Although we listen to users' suggestions for new message boards, we cannot guarantee to include every topic equested.

We reserve the right to remove postings to message boards or edit them at our discretion, but we have no obligation to do so.

Subscribers must ensure only they use those message boards and they do not allow non-subscribers to use them using a subscriber's own password.

Subscribers must keep their passwords confidential.

5.Our iability

We provide most information on this site free of any access charge. Whether you are charged or not for the information provided on this site, it is provided on the basis of no liability for the information given. Where we provide a chargeable service to you we accept liability for direct loss arising from our not having used reasonable skill and care in the provision of such services up to the price you have paid us in any year, in the year of claim.

In no event shall we be liable to you for, in the case of non-chargeable services, any direct, and for both chargeable and non-chargeable services, any indirect or consequential loss, loss of profit, revenue or good will arising from your use of the site or information on the sites. Subject as provided below, all terms implied by law are excluded.

We accept liability for death or personal injury caused by negligence or responsibility for fraudulent misrepresentation that cannot, under English law, be excluded.

7.Chargeable services

Any chargeable services are clearly marked as chargeable on the site and the price is shown. You provide your card details as payment, in advance.

You may only use your own card and not someone else's and you may only order for yourself for your own private investment purposes.

You must be 18 years (or older if the age of majority is older in your country).

We reserve the right to reject any order at our discretion without giving any reason to you.

Our liability for our services ordered by you is set out in paragraph 5 and otherwise in these terms.

You may terminate a chargeable service at any time.

Where you purchase goods or services having been directed from the site through a link to a third party such as a broker, pensions supplier or health insurer, any contract you may choose to form with them, or use of their web site, is a matter between you and them. We do not accept any liability for the quality or type of services or goods provided by those whom we mention on our site or to whom we have linked our site. It is for you to make your own judgment about the quality of such providers. We exclude all liability both under contract and under the law of tort, including without limitation, liability for misrepresentation to the fullest extent permitted by law in this respect.

8.Booking services

Where we enable users of the site to book accommodation through the site then we, or our agents, are acting as an agent on behalf of the accommodation provider and therefore the contract for the booking is directly between you and the accommodation provider. On arrival you should check that the accommodation is as booked, including type of board and price. Any booking made through us will not become effective until it has been confirmed by the accommodation provider.

We do not assume any liability for bookings made with accommodation provider.

We reserve the right to provide alternative accommodation if your first choice is unavailable and any contract will be between you and the alternative accommodation provider.

At the time of booking we will charge you a deposit* towards the cost of the accommodation which will be deducted from your account by the accommodation provider on production of your confirmation document. This deposit is non-refundable to either the accommodation provider or the guest for any reason whatsoever.

When making a booking you authorise us to pass on all your personal details and your credit/debit card information to the accommodation provider. We have no control over your information and credit/debit card information once we pass the material on to this third party. You accept that we have no liability as a result of passing such information on to a third party.

In the event that you fail to take up the accommodation by the time stated, without prior arrangement with the accommodation provider, then the booking will automatically be cancelled and the deposit forfeited. You will be liable for the accommodation providers' usual cancellation charges, which may be up to 100% of the booking value. You should familiarise yourself with the accommodation providers own terms and conditions when making a booking through us.

We cannot guarantee the level or quality of any accommodation provided and you must satisfy yourself when making a booking that the accommodation meets your expectations and particular needs. We cannot be held responsible nor accept any liability for complaints or claims of any nature arising from this booking, nor for loss or damage which may be suffered by you, or other members of your party, during or as a result of your stay at the accommodation establishment.

To the best of our knowledge all prices quoted are inclusive of VAT and service.

*The deposit taken from the guest represents the booking commission payable by the accommodation provider to CV One ltd and is 8% or 10% of the total stay (8% for CV One accommodation members and 10% for accommodation non members)

9.Legal jurisdiction and dispute resolution

English law shall apply to these terms, notwithstanding the jurisdiction where you are based. You irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts. The place of performance shall be England.

We make no warranty or guarantee that the site, or information available over the site, complies with laws other than those of England.

10.General

Any formal legal notices should be sent to us at the address at the end of these terms by email confirmed by post.

Failure by us to enforce a right does not result in waiver of such right.

You may not assign or transfer your rights under this agreement.

We may amend these Terms at any time by posting a variation on the Sites.

11. Prize draw terms & conditions

The prize draw competition is open to UK residents only (excluding Northern Ireland). Overseas entries will not be considered.

If you are under the age of 16 you must obtain permission from your parent/guardian before you enter CV One prize draw competitions.

No purchase necessary.

Only one entry will be accepted per person.

CV One Limited will only ever use your personal details for the purposes of administering this competition, and will not provide them to any 3rd party without your written permission. If you would like to know more about CV One's privacy policy, please see our Privacy Policy.

The first name randomly drawn from entries after the closing date will be the winner.

The winner will be contacted personally by telephone or email within one month of the closing date.

The prize must be taken as stated, cannot be deferred and is non-transferable. The prize cannot be used in conjunction with any other offer or discount. Unclaimed prizes will be deemed to have been forfeited and CV One Limited reserves the right to either offer the prize to the entrant whose name is next drawn at random, or to re-offer the prize in any future competition on the visitcoventryandwarwickshire website.

Entrants will be deemed to have accepted these rules and to agree to be bound by them when entering this competition.

CV One Limited does not accept any responsibility for late, timed out or lost entries. Proof of sending is not proof of receipt.

No responsibility is accepted for ineligible entries or entries made fraudulently.

This competition is not open to employees or contractors of CV One Limited, any person directly or indirectly involved in CV One Limited or the running of the competition, or their direct family members. CV One Limited reserves the right to cancel prize draw competitions at any stage, if deemed necessary in its opinion, and if circumstances arise outside of its control. CV One Limited reserves the right to publish the winner's name on the www.visitcoventryandwarwickshire.co.uk website.

These rules are governed by the laws of England and Wales.

This competition is administered by CV One Limited. CV One Limited's decision is final and no correspondence will be entered into.
